 1.         Defined Terms
          1.1        Landlords Choice is the trading name of Drive Innovation Pty Ltd, which owns and operates the website www.landlordschoice.com.au.
            1.2        “We”, “us” and “Agent” means Drive Innovation Pty Ltd, ABN 99 129 037 681, its directors and employees.
            1.3        “Principal” means the owner, registered proprietor, of the property to be leased.
            1.4        “Property” means the residential property to be leased.
            1.5        “Package Prices” means the fees for our services we refer to on the Services Page.
            1.6        “Services Page” means the webpage listing our services on this website.
2.         We are the holder of Property, Stock and Business Agents Act 2002 Licence No: 10035277.
3.         By purchasing one of our services packages, the Principal agrees to these Terms and Conditions.
4.         The Principal warrants that the Principal has the legal capacity and lawful entitlement to advertise the property for rent, meaning the Principal is the owner of the property or has been authorised by the owner.

5.         Landlords Choice complies with the Private Listing Policy of realestate.com.au.

6.         These terms and conditions are governed by the law in the Australian State or Territory the property is located in.

7.         Terms of Site Use
            7.1        The Principal warrants that all information completed in the Leasing Agency Agreement, as relates to the property, is true and accurate.
            7.2        Unauthorised use of this site is prohibited.
            7.3        Any person/legal entity who/which uses this site without proper and lawful authority agrees to indemnify and keep indemnified us against all and any liability, loss and damage of whatsoever kind caused by such improper and unlawful use.
8.         Landlords Choice owns and retains all intellectual property and proprietary rights in this website and the services we provide. Landlords Choice website materials may not be published, transmitted, edited, reproduced, copied, or otherwise used in any way without the express written permission of Landlords Choice.
9.         Privacy Policy
            9.1      Landlords Choice is the trading name of Drive Innovation Pty Ltd referred to as “we”, “us”, “Agent” in these terms and conditions.
            9.2      Landlords Choice requires and is provided with personal information in relation to the operation of this website and in the conduct of its business and promotion of the services we provide and our obligations under the Leasing Agency Agreement.
            9.3      Landlords Choice is required to comply with the provisions of the Privacy Act 1988, as amended, and will only disclose personal information as permitted by the Privacy Act.
            9.4      Landlords Choice collects personal information, primarily in relation to the “Principal” and in relation to users of this website, the services we provide and to other people Landlords Choice deals with in the conduct of our business.  Personal information may include but is not limited to your name, email address, telephone number, postal address for shipping items, options on receiving updates and promotional material, usernames and password.
            9.5      We may disclose personal information to other people, including advisors, media organisations, property data service providers, on the internet, to potential tenants, to clients of the Agent, both existing and potential, as well as to tradespeople, owners’ corporations, valuers, government and statutory bodies, and to third parties as required by law.  Your personal information will not be disclosed to overseas parties.
            9.6      We will only disclose personal information to other parties as is required in the performance of duties and obligations and to achieve purposes specified in accordance with the Leasing Agency Agreement, or as otherwise allowed under the Privacy Act.
            9.7      Otherwise and as required in the conduct of our business, personal information will only be disclosed in circumstances where we are legally bound to do so. In circumstances considered necessary we will seek the consent of the person concerned before determining if any personal information is to be disclosed to another person.
            9.8      The provisions of the Privacy Act permit access to your personal information which has been recorded. We will provide access upon request and access will be granted unless we are required by law not to do so.
            9.9       In order to ensure the security and integrity of the personal information we collect through our website,
                        we have suitable security measures and protocols, which we maintain and update on a regular basis.
                        However, we cannot guarantee that the data we collect will not be compromised by unauthorised
                        access in breach of our Privacy Policy.
           9.10     We use our best endeavours to ensure that all personal information recorded is up to date, accurate and complete. Any changes can be made by contacting our Privacy Officer.
