 1.         Defined Terms

1.1 Landlords Choice is the trading name of Drive Innovation Pty Ltd, which owns and operates the website www.landlordschoice.com.au.

1.2 “We”, “us” and “Agent” means Drive Innovation Pty Ltd, ABN 99 129 037 681, it’s directors and employees.

1.3 “Principal” and “Owner” means the registered proprietor of the property referred to in the property listing and any person authorised to act on behalf on the owner.

1.4 “Property” means the residential property to be sold.

1.5 “Package Prices” means the fees for our services we refer to on the Services page.

1.6 “Services Page” means the webpage listing our services on this website.

2. We are the holder of Property, Stock and Business Agents Act 2002 Licence No: 10035277.

3. By purchasing one of our services packages, the Principal agrees to these Terms and Conditions.

4. The Principal warrants, and we rely upon this warranty, that the Principal has the legal capacity and lawful entitlement to advertise the property for sale, meaning the Principal is the owner of the property or has been authorised by the owner.

5. Landlords Choice complies with the Private Listing Policy of realestate.com.au.

6. These terms and conditions are governed by the law in the Australian State or Territory the property is located in.

7.         Owner’s Obligations.
            7.1      To provide precise and correct property and property owner identification details and all other relevant information for the property listing.
            7.2      To pay the service fee as disclosed in the Sale Package and in the manner specified.
            7.3      To maintain confidentiality in relation to password/PIN access and use.
            7.4      To keep updated property listing information.
            7.5      To have a proposed contract for sale prepared before listing the property for sale through Landlords Choice.
8.         Terms of Site Use
            8.1      The owner warrants that all information provided in relation to the property and the listing for sale is true, accurate and correct.
            8.2      Unauthorised use of this site is prohibited.
            8.3      Any person/legal entity who/which uses this site without proper and lawful authority agrees to indemnify and keep us indemnified against all and any liability, loss and damage of whatsoever kind caused by such improper and unlawful use.
            8.4      We publish information on this website as provided by other persons, in good faith. We do not provide any undertakings, warranties, or guarantees as to the correctness, completeness, currency or otherwise of such information as referred to on this website.
            8.5      To the extent permitted by law, all users of this website agree to release us from all claims for damages of any nature relating to accessing and using this website.
            8.6      Use of this website constitutes acknowledgement, agreement and acceptance of the terms and conditions of this website.
9.         Landlords Choice owns and retains all intellectual property and proprietary rights in this website and the services we provide. Landlords Choice website materials may not be published, transmitted, edited, reproduced, copied, or otherwise used in any way without the express written permission of Landlords Choice.
10.         Privacy Policy
            10.1      Protecting your privacy and the confidentiality of your personal information is fundamental to the business we conduct on this website. We are sensitive to privacy issues and protecting your private information.

            10.3      Landlords Choice is required to comply with the provisions of the Privacy Act 1988, as amended, and will only disclose personal information as permitted by the Privacy Act.
            10.4      Landlords Choice collects personal information, primarily in relation to the “Owner”and in relation to users of this website, the services we provide and to other people Landlords Choice deals with in the conduct of our business.
            10.5      We may disclose personal information to other people including property data service providers, potential buyers/purchasers, other linked and third party internet sites, valuers, government and statutory bodies as is required for the purpose of and incidental to operating this website and otherwise as required by law.  Your personal information will not be disclosed to overseas parties.
            10.6      We will only disclose personal information to other parties as is required in the performance of duties and obligations and to achieve purposes specified in accordance with the property sales listing, or as otherwise allowed under the Privacy Act.
            10.7      Otherwise and as required in the conduct of our business, personal information will only be disclosed in circumstances where we are legally bound to do so. In circumstances considered necessary we will seek the consent of the person concerned before determining if any personal information is to be disclosed to another person.
           10.8      The provisions of the Privacy Act permit access to your personal information which has been recorded. We will provide access upon request and access will be granted unless we are required by law not to do so.
           10.9       In order to ensure the security and integrity of the personal information we collect through our website, we have suitable security measures and protocols in place, which we maintain and update on a regular basis. However, we can not guarantee that the data we collect will not be compromised by unauthorised access in breach of our Privacy Policy.
